In Bengaluru, the Karnataka High Court has criticized three police officers for wrongly charging two students under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, despite a forensic report proving their innocence. The students, Hanumantha and Manjunatha from Gunjur near Varthur, had their lives affected by the false accusations. The court ordered disciplinary action or departmental inquiry against the Station House Officer (SHO), the complainant officer, and the investigating officer. The incident occurred in August 2019 when probationary officer Raj Kumar alleged he caught the students consuming ganja near Krupanidhi College. Blood tests showed no drugs, but a chargesheet was still filed. The students suffered personally and professionally, losing job opportunities. The SHO admitted the mistake in court. Justice Nagaprasanna highlighted several illegalities in the case.The judge highlighted that the petitioners continue to face adverse consequences due to the failure of police officers to send the alleged 15 grams of marijuana to the FSL, incomplete seizure records, and the omission of complainant Raj Kumar as a witness in the chargesheet. The judge emphasized the severity of the situation, as evidenced by the FSL report proving that the blood samples did not contain any illegal substances, contrary to what was recorded in the chargesheet. The judge held the responsible officers, including the station house officer, investigating officer, and complainant, accountable for jeopardizing the lives of the accused individuals. A departmental inquiry was directed to be initiated by the disciplinary authority, and a circular was to be released mandating all officers to adhere to specific legal sections and court rulings related to drug cases. The court emphasized the importance of combating drug-related crimes while strictly following legal procedures to prevent accused individuals from exploiting any procedural weaknesses.
